    Hi,
    my original labor got approved with a PD in July 2007 with Company A who is my current employer. I also applied for a seperate 140 based on a pre-approved labor in July 2007 with Company B and the PD for that labor is in 2005.

    i was told that i can apply for 140/485 with my original labor and once the 140 for the pre-approved labor is approved, i can request for replacing the 140 with the other one with an earlier PD.

    could any one repalce the 140 like this? if yes, how long it took for the process. does both 140 needs to be approved to do the interfiling?

    what details we need for the 140 that we want to use. just the filing date, A# & approval date or the original or copy of the approval notice.

    if Company B or its attoreny is not willing to provide the 140 details or approval notice, is there any way to get those details from INS.

    i dont have any details with me except that i know that they applied for 140.

    Technically ...... "ZERO" (no time-gap).
    But don't worry about it too much (what can you do). Get your next job ASAP, and file for "premium processing".

    In the past "extension of status" petitions had got approved even after almost a month gap, with good explanation. But you can never count on that.

    Worst thing that can happen for a valid new H1 job is USCIS approve your H1 but reject your "extension of status" (I797 without I-94 attached). In that case, you might need to travel outside of USA and get your visa.

    Either way, don't go beyond 180 days. There will be additional consequences.

    Hello, I lost my job today, but I have H1B. So what's the time gap for finding a new job?

    Hi,
    My attorney filed for H1B extension.
    Unfortunately, by mistake LCA stating dates from 07/31/2007 to 07/30/2010.
    but I am only qualify upto 06/30/2010 as per 6 year H1B limit.
    Atty, told me that 1-129 going to file upto 06/30/2010.
    Is it o.k.

    You can file an amendment. Mistakes is so common at USCIS.

    If you dont want to, I think you can recapture your unused time on h1b and get h1b for extended period based on time not in the US. Check with attorney and see if you can get h1b extension for all the time you were not in US.

    Thank you so much for your input .Right now I'm in a kind of predicament that my current employer told me in the middle of premium processing that he was hiring another person in my place.Then, when I spoke with my attorney he said we couldn't do anything in the middle of the process but to go ahead with it.I was approved for H1B 3 days after this incident.But, I have never worked for them since then and it's been a month trying to find another non-profit employer.So, in the midst of all this scenario, what would be the next alternative to be in the USA, how long I can be like this , I dont have a single pay stub, so can I show a reason that I was sick /or leave of absence when I find another job and include this kind of document with the peition or can do nothing for this period of time in the new petition.Could anybody please help me and Thanks in advance.

    "US Consulate General, Hyderabad, Cornelis M Keur addressing media persons at the 'meet the press' programme organised by Press Club Hyderabad said that due to economic slowdown the world over, the US government has taken a decision to tie up its unemployment problem which is nine per cent. But, there was no significant change in visa policy. "We continue to issue H1B visas with little more scrutiny," Keur said.


    He said that, at the same time, the US government has framed a policy for the companies to give preference to native Americans in employment.


    Obama administration has taken up a practical approach in establishing relations with the countries while there were efforts in strengthening relations with India because of the "Brain Borrowing", he said.


    Keur said there are 3 million Indians in the US who are contributing to its prosperity specially mentioning about the Andhraites who marked their presence in various fields in the US including IT.


    Keur said the Hyderabad Consulate, the fourth in the country was established due to the growing trade and development in the state in the IT, biotechnology and pharma sectors."

    few days ago, I tried to extend H4 visa for my spouse but I heard through one of the lawyer in the firm that once H4 visa holder used EAD, H4 becames invalid unless you enter again in POE using H4, we cant apply for H4 extension as the current status is AOS. But we are still exploring it.

    I checked in H4 extension form I-539, they ask:
    1. current immigration status?
    2. whether you want to extend current status or change of status?

    But my spouse is working so if we say change status to H4 from AOS then not sure whether she can use immediately EAD to work? I opened a thread regarding this.

    Anybody experienced the same issue as above? Thanks.

    Since you have Valid H1b, using H1b is better option. EAD � you need to renew it every year. If you are in EAD, then you have to have AP (if you want to travel abroad) which also you need to renew every year.

    If anything goes wrong in your I485 (just in case) you will be in trouble, but that is not the case if you are in H1B. I am not saying EAD is bad, but comparatively Valid H1b is a better option.

    If your previous employer won't revoke I140, then no issues, even revoking of approved I140 by your previous employer will not have any effect as you have completed 180 days after filing your I485.

    i got my i140 approved ,i-485 applied >180 days with my old employer.i have my h1b till 2010.Now i got an offer from a new company who is willing to do my h1b transfer and they said no need for doing labour,i140 again.
    i am confused. is that safe if i do h1b transfer and keeping old employer's i140.(they won't revoke).Are its better to use ead to avoid confusion in GC process.pls show me the light.
